TERMS AND CONDITIONS - THE DROP FESTIVAL
TICKETING

This ticket is sold or provided on the express condition that the holder (“Ticketholder”/“Patron”) is bound by the rules & regulations issued by The Drop Music Festival Pty Ltd (“the Organiser”/“Promoter”).
Ticketholders agree to be bound by the Terms and Conditions (“Conditions”). contained herein and available on The Drop Festival website. These Conditions work in conjunction with the Promoter’s authorised ticket seller’s terms of service (“Ticket Terms”), available on the Eventbrite Australia website.

The Drop Festival Conditions govern the supply of all tickets (including complimentary tickets) to the Event that are issued by the Promoter, or the Promoter’s authorised ticket seller Eventbrite and the ticket allows access to certain specified areas of the venue where the Event is held. Some areas are restricted.

It is a condition of purchase that the Ticketholder consents to the Organiser collecting and retaining their personal information which has been freely provided by the ticketholder. The Organiser will hold your information in accordance with the Privacy Act 1988 (Cth) and for the purpose of contacting you in relation to ticketing matters and Event information. The Organiser will not trade or sell your personal information.

Tickets purchased or acquired by ticketholders may not be used for advertising, promotion or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services. If a ticket is sold or used in breach of this condition, the bearer of the ticket will be refused admission to the Venue and the Organiser reserves its right to take further legal action against any parties that have breached this condition.

Only tickets purchased from Eventbrite will be honoured. Do not purchase your ticket from any third-party or unauthorised websites including but not limited to Viagogo, Gumtree and Facebook. Failure to purchase a ticket from an authorised outlet may result in refusal of entry. The Organiser may involve the police regarding the falsification of tickets to events.

The sale or re-sale of a ticket by the Ticketholder (including online auction sites) by any method other than the official re-sale managed by Tixel is prohibited. Tixel is our official resale partner for this event, and this process ensures that everyone is

protected when buying and selling tickets. The organiser will notify ticketholders of resale facility, no sooner than 6 weeks after the general “on sale” of the Event.

The Organiser reserves the right to enforce published ticket purchase limits and cancel any tickets obtained above said limits by any one customer.

REFUNDS / CREDITS / REPLACEMENTS

There shall be no refunds on tickets except as required by law &/or specified by the Live Performance Australia Ticketing Code of Practice. Incorrect or accidental purchases DO NOT qualify for a refund or exchange.

No refund, credit or replacement tickets will be provided on any complimentary tickets; tickets which have been purchased from an unauthorized ticket seller or in situations where the Australian Consumer Law (ACL) does not apply.

If the Event does not commence at all for whatever reason, you will be entitled to a refund for the face value price of the ticket (inclusive of booking fees but excluding credit card fees, transaction fees and mailing fees) or credit or replacement ticket for the Event (as designated on your ticket).

If the Event is rescheduled or relocated your ticket will remain valid for the reschedule date or location. If you are unable to attend the re-scheduled or re-located Event, you will be entitled to a refund for the face value price of the ticket (inclusive of booking fees but excluding credit card fees, transaction fees and mailing fees).

If you are entitled to a refund in accordance with the above, you should contact the authorised ticket seller within 14 days of the Event being cancelled, re-scheduled or relocated to obtain information regarding the refund, including the period in which you have to obtain a refund. To verify the authenticity of the original ticket, proof of purchase may be required if you are seeking a refund pursuant to this clause.

Without limiting the foregoing, you acknowledge that you are attending a festival with numerous artists programmed to perform at the Event and that the artists performing at the Event varies between locations where the Event is staged and that no refunds, credits, replacement tickets or other compensation will be provided if there is a change to the line-up of the performers at the Event. The organisers will use best efforts to ensure the published line up performs at the event.

ENTRY TO THE EVENT

Ticketholders MUST show valid Photo ID at the Event entrance bearing the same name and date of birth details as those printed on their Event Ticket.

Entry to the Event and Venue and your continued presence at the Event and in the Venue is conditional upon you agreeing to be reasonably searched (including searches of your person, bags, clothes or other possessions) by means of a physical search or metal detector on entry and while in the Venue. You also agree to selected ID scanning upon entry.

If for good reason you are removed from the Venue or the Event and/or denied entry to the Venue or the Event, you will not be entitled to any ticket refund in part or in full and/or compensation.

Do not share your ticket barcode with anyone else or you may be denied entry. The Organiser reserves the right to deny admission to the holder of any ticket that appears to have been tampered with, counterfeited or duplicated.

Upon entry your ticket will be exchanged for a wristband that you MUST keep on for the duration of the Event. Lost, damaged or stolen wristbands will not be replaced.

Anyone entering the Venue or found onsite at the Event without a valid wristband, will be deemed to have trespassed and removed from the Venue and will be handed over to the Police. Maximum penalties apply.

No pass outs will be issued unless otherwise advised or in the case of extreme weather conditions or emergency situations.

It is strictly forbidden for you to enter restricted areas such as backstage, production sites or offices. Doing so will result in immediate ejection from the event

Any person gaining unauthorised access to the Event or Venue may be liable to prosecution. The organisers will use best efforts to organise a safe venue however entry to the event is at your own risk. The right to refuse entry is reserved.

Ticketholders aged 15 years and under must be accompanied by a responsible parent and/or adult guardian holding a valid Event ticket when entering the Event and at all times whilst at the Event. We strongly recommend this parent and/or adult guardian is aged 25 years or older.

Ticketholders aged 15 years and under not accompanied by a responsible parent and/or adult guardian holding a valid Event ticket will be denied entry into the Event or removed from the venue.

We strongly recommend that persons aged 16 and 17 years old are accompanied by a responsible parent and/or adult guardian aged 25 years or older.

Persons aged 11 years and over must purchase a ticket to the Event. Those aged 10 years and under are admitted into the Event free of charge. For the avoidance of doubt, all persons aged 15 years and under must be accompanied by a responsible parent and/or adult guardian holding a valid Event ticket when entering the Event and at all times whilst at the Event.

PROHIBITED ITEMS

Alcohol cannot be brought into the Venue. Any alcohol brought into the Venue will be confiscated and will not be returned. The Organiser reserves the right to take appropriate action in such circumstances including expelling the ticketholder.

Empty plastic/reusable bottles may be brought into the Event precinct for refilling from water stations. NO METAL BOTTLES ARE ALLOWED.

Bags, containers and other personal items will be searched at the entry to the Venue to check for any banned items. The No Large Bag policy will be enforced. Prohibited items include glass, alcohol, weapons, umbrellas, selfie sticks, video cameras (including GoPros), and drones. Banned items will be confiscated and not returned. Flares and fireworks are considered to be an extremely harmful weapon. If a patron is found with a flare they will be immediately ejected, banned from future events indefinitely and may be prosecuted.

Protest and political paraphernalia and banners are not allowed in the Event or at the Venue. Clothing, jewellery or accessory displaying the name of any motorcycle related or similar organisations or any ‘declared organisation’ within the meaning of the Crimes (Criminal Organisation Control) Act 2009 will not be permitted in the Event or at the Venue. The Organiser reserves the right to remove any person in possession of or displaying these items, or any item which is deemed racist, vilifying, sexist and/or offensive.

Animals are prohibited at the Venue, with the exception of service or assistance animals, such as Guide Dogs.

Drinks, food and medication required for dietary or health purposes are allowed at the discretion of the promoter. Please see the contact section of the website for details. It will require a written consent from a registered medical health professional.

Small still cameras are permitted but professional audio or video recording devices, including GoPros, and professional still cameras are prohibited. Ticketholders are not permitted to record the Event (audio or video) for commercial purposes.

All Ticketholders consent to be included free of charge in any official photography, filming & sound recording by the Organiser and/or any of its authorised representatives and contractors and grant the Organiser the right to use such recordings for promotion and other legal purposes.

Possession, sale or use of illegal drugs or illicit substances is strictly prohibited at the Venue and the Event. Any persons found with illegal drugs or illicit substances in their possession may be removed from the Venue and subject to Police action.

The Organiser reserves the right to refuse a Ticketholder admission to the Venue and the Event and/or to evict any person from the Venue and the Event if they are affected by alcohol or drugs, or act in contravention of any of these Terms and Conditions.

CONDUCT

The Venue is a licensed area. Patrons wishing to purchase and/or consume alcohol must be over 18 years of age and have valid photographic ID. Anyone found supplying or buying alcohol for a minor will be evicted from the Event & may face criminal charges. Any minor found consuming or in possession of alcohol will face similar action.

Activities such as moshing, crowd surfing, climbing and stage diving are strictly prohibited. Patrons engaging in these or other dangerous activities will be removed from the Venue, and patrons accept all risk and liability for any injuries or damages caused by these activities. Entry to the Venue is at the Ticketholder’s own risk.

The Organiser recommends that due to noise levels, ear plugs should be carried/worn by patrons. Offensive language may be used by some performers and artists. Special effects and strobe lighting may be used at the Event.

Patrons must not cause damage to, improperly use, or tamper with any Venue facility or Event infrastructure, or cause any damage to flora and fauna on or surrounding the Venue or enter any onsite bodies of water at the Venue. Patrons must not remove or attempt to remove any item or object from the Venue or surrounding area. Patrons accept full liability and responsibility for any loss or damage caused in contravention of this clause or any other term of these Terms and Conditions.

Ticketholders must use designated walkways and paths at all times whilst at the Event and the Venue and follow any Event or Venue directions or signage.

Patrons may be removed from the Venue if, in the opinion of the Organiser, they behave or act in a threatening or inappropriate manner, including without limitation, any aggressive, riotous, abusive, offensive, racist, sexist or insulting actions towards other patrons, Event staff or any other persons at the Venue or the Event. Patrons are required to follow the reasonable directions of the Organiser and Event staff at all times.

In the event of an emergency situation or evacuation, you must follow all official directions by Venue and Promoter’s staff & security. For safety reasons the promoter reserves the right to stop the event, interrupt or partially vacate the site, deny access to the site regardless of the possession of a valid ticket and deny access to certain areas to control crowd safety.

NO REPRESENTATION

Ticketholder acknowledges that there may be restricted capacities at some of the Event’s stages or venues and ticket purchase does not guarantee entry to these areas in such circumstances. Once it is determined by the Organiser (at its sole discretion) that the maximum capacity has been reached in these areas, there will be no further admissions.

The Organiser reserves the right to vary the Event program and/or to add, withdraw or substitute artists. No ticket refunds or compensation will be made in such circumstances, or if the Event program varies due to the non-appearance of an advertised artist. The Event will take place rain, hail or shine but maybe terminated in cases of extreme weather conditions at the sole discretion of the organisers.

YOUR SAFETY

Whilst at the Event and in the Venue, you must take care to protect your safety and the safety of others. You are required to take appropriate care for your sun protection & hydration. Free water and suncream is available at various locations around the Event. You must wear appropriate footwear and clothing at all times. Volume levels at all outdoor events vary depending on many factors such as Environmental Protection Agency noise restrictions and we recommend that you take appropriate care for your hearing protection, including using earplugs. If you feel at any time that your, or anyone else’s health or safety is threatened, you should contact the nearest security guard or First Aid Officer.

By entering the Event and using the venue and medical facilities, you consent to allow the promoter or its representatives to receive personal information from the medical service providers that has been obtained during treatment during and after the event.

In the event of injury or illness the Organiser may, at the cost of the Ticketholder, arrange medical treatment and/or emergency evacuation as deemed essential for the safety of the Ticketholder.

General admission audiences may cause recreational risk. You are admitted to the Event and Venue at your own risk. Where fun rides are present at the Event, you use such fun rides at your own risk. The Organiser will not be liable for any loss or damage (including any direct, indirect or consequential loss or damage) for any death or personal injury, unless the ACL applies and it was due to Organiser’s breach of a non- excludable guarantee under the ACL such as failure to provide services with due care or skill.

The Venue will not be liable for any loss or damage (including any direct, indirect or consequential loss or damage) for any death or personal injury, unless the ACL applies and it was due to the Venue’s breach of a non-excludable guarantee under the ACL such as failure to provide services with due care or skill.

Footwear must be worn at all times throughout the Event site.

Police have the right to attend the event and have the right to question and eject patrons from the event for offences including but not limited to being suspected of possessing illegal substances, weapons or contraband. Patrons should respect police and be compliant with their reasonable requests.

INTELLECTUAL PROPERTY

The words “The Drop” and The Drop logo are registered trademarks. The name, logo, images, tickets or other works associated with the Event cannot be used in any way (including promotions, advertising & ticket giveaways or in any way to enhance the demand for other goods or services) unless authorized in writing by the Promoter.

LIABILITY

Except where liability cannot be excluded by law, the Organiser (and its employees, contractors and agents) shall not be liable for any loss, cost, expense, injury, claim or damages suffered or sustained by any Ticketholders and patrons at the Venue or the Event. Where permitted under the Australian Consumer Law (ACL), the Organiser limits its liability in respect of breach of any statutory guarantee under the ACL in the manner set out in sections 64A(1)(a) and 64A(2)(a) of the ACL.

To the full extent permitted by law, Ticketholders waive all legal rights of action against and fully release the Organiser, its agents, employees and volunteers for all claims for compensation for loss, damage, injury or death howsoever arising out of or in relation to the Ticketholder’s entry to and presence at the Venue and their attendance at the Event.

To the extent permitted by law: (a) the Promoter and the Venue’s maximum liability to you for any loss or damage that is suffered by you as a result of any breach of these conditions by the Promoter and/or the Venue is limited at Promoter’s sole discretion to: (A) the replacement of tickets; or (B) permitted entry to a rescheduled Event or other Promoter event; or (C) a refund where required; (D) all other representations, conditions, warranties and terms (including claims in relation to any particular performances) that would otherwise be expressed or implied in these conditions by general law, statute or custom are expressly excluded.

Where rides are on site, rides will be ridden at your own risk. The promoter accepts no responsibility for your actions.

GENERAL

These Conditions do not exclude, restrict or modify the application of any provision of the ACL, where to do so would either contravene the ACL or cause any part of these conditions to be void. Any provision of these conditions which is invalid must be read down to the minimum extent necessary to achieve its validity or be severed from these conditions without invalidating or affecting the remaining provisions of these conditions.

References to the Promoter and the Venue, include references to their staff, contractors, agents, volunteers. Where the word including is used, or examples are given, it does not limit the generality of the clause. If there are any inconsistencies between these conditions and any of the conditions in the Ticket Terms, these Conditions prevail.

Any provision of these Terms and Conditions which are or becomes unenforceable shall not invalidate the other provisions of these Terms and Conditions.

These Terms and Conditions may be amended by the Promoter from time to time without notice.
